State Government Given Extension to Respond to Removal of Encroachments on Monuments

The Lucknow bench of the Allahabad High Court has given the state government an extension to submit a further affidavit concerning the removal of encroachments and notices served to encroachers at protected monuments in Lucknow. The court has also permitted the inclusion of Hussainabad & Allied Trust, Lucknow, as a party-respondent in the case related to safeguarding monuments in the city. The Trust has been given until March 29 to provide their response. This decision was made by a division bench led by Chief Justice Arun Bhansali and Justice Jaspreet Singh on March 18, following a Public Interest Litigation (PIL) filed by local lawyer Syed Mohammad Haider Rizvi in 2013. The PIL requested court intervention to safeguard the historical monuments in Lucknow and clear them of encroachments. The court had previously issued directives to address this issue. In a recent order dated September 19, 2023, the senior registrar of the court was instructed to report on the progress of meetings conducted in compliance with court orders. As this directive had not been acted upon, the court directed the registrar to take necessary actions promptly. The state’s counsel was also granted an extension to submit a further affidavit regarding the removal of encroachments and related notices. The next hearing for this matter is scheduled for March 29.
